Terms of Service
1. Platform Scope & Independent Users
Karmup is a technology platform operated by Shivion Solutions that enables users to discover, request, offer, communicate about, and participate in lawful assistance, services, exchanges, and other permitted activities.
Under Section 2(1)(w) and Section 79 of the Information Technology Act, 2000, Karmup operates as a technology intermediary entitled to statutory safe harbor. Karmup functions as a non-inventory marketplace facilitator under the Consumer Protection (E-Commerce) Rules, 2020, connecting independent users and holding no custodial control over user-generated communications or direct peer settlement transactions.
Karmup does not itself provide every service listed on the platform. Unless expressly stated otherwise, services and assistance are provided by independent third-party users.
Users independently decide whether to create, accept, decline, communicate about, pay for, or participate in any request, service, or transaction. Users are solely responsible for their own decisions, conduct, representations, services, requests, transactions, and compliance with applicable Indian law.
Karmup does not warrant that another user is trustworthy, qualified, suitable, safe, reliable, or capable of performing a particular task.
2. What Karmup Is Not
Karmup is not and should not be construed as:
- An employer, employment agency, or staffing firm.
- A commercial transport, taxi, or cab aggregator.
- An ambulance, hospital, doctor, nurse, or emergency dispatch service.
- A police department or emergency public safety authority.
- A licensed courier company or freight forwarder.
- A professional licensing or accreditation body.
- A background check or criminal verification agency.
- A bank, wallet provider, or financial institution holding or custodializing user task funds.
- An insurer or guarantor of user conduct or task performance.
Where any regulated activity is requested or offered, the relevant user remains solely responsible for holding all required licences, permits, registrations, and vehicle fitness certificates.
3. Payment Model, Direct Settlement & 4.5% Platform Fee Terms
Direct Peer Payments: Requesters agree the task price directly with the Helper prior to commencement. Upon completion, the Requester pays the Helper directly 100% using an accepted payment mode (UPI, QR code, or cash). Karmup does not collect, hold, or transfer task funds between users.
4.5% Platform Fee & ₹45 Dues Threshold: Karmup operates a transparent 4.5% platform fee on completed tasks. Fees accrue as platform dues in the helper account. When accrued dues reach the ₹45 threshold (after earning ₹1,000 in completed tasks), the helper must clear dues via secure gateway to accept new tasks. Completing in-progress tasks, chat, and support access are never restricted.
Fee Adjustments and Prior Notice Clause (Pending Legal Review): Karmup will provide users with advance notice (at least 15 to 30 days prior) before introducing any adjustment to platform fee schedules or dues thresholds. No fee adjustment will ever be introduced retroactively.
4. User Eligibility, Conduct & Strict 18+ Rule
Mandatory Rule: Karmup is strictly restricted to adult individuals aged 18 and older. Any registration, account creation, task posting, or task execution by individuals under the age of 18 (minors) is strictly prohibited and subject to immediate account termination.
By accessing or using the platform, users represent and warrant that they:
- Strictly 18+ Adult Users: Are at least 18 years of age and legally competent to enter into binding agreements under the Indian Contract Act, 1872.
- Provide accurate, genuine information during registration and in task descriptions.
- Will strictly adhere to the Community Guidelines and Prohibited Activities Policy.
- Are solely responsible for meeting arrangements, safety precautions, and personal property.
- Will maintain strictly one account per verified mobile phone number. Creating multiple accounts with the same phone number or deleting and recreating accounts to evade platform dues or account strikes is strictly prohibited.
- Will not request or facilitate any hazardous, fraudulent, or unlawful activities.
5. Limitation of Liability
To the maximum extent permitted by applicable law, Karmup and Shivion Solutions shall not be liable for indirect, incidental, special, consequential, or similar losses arising from interactions, communications, services, requests, transactions, exchanges, or conduct between users.
Karmup is not responsible for independent acts, omissions, representations, communications, services, transactions, or misconduct of users, except to the extent responsibility cannot legally be excluded or limited under applicable law.
Nothing in these Terms excludes or limits any statutory liability that cannot legally be excluded or limited under applicable Indian legislation.
6. Account Suspension and Termination
Karmup reserves the right to restrict, suspend, or permanently terminate accounts, remove task postings, or decline service to any user who:
- Engages in prohibited activities, harassment, discrimination, or fraud.
- Manipulates ratings, reviews, or task completion records.
- Repeatedly fails to honor agreed tasks or violates platform rules.
- Provides false or misleading verification details.
7. No-Show Policy, Account Pauses, Appeals & Acknowledgement Logging (Pending Legal Review)
To ensure community reliability and honour peer commitments, Karmup enforces a structured no-show and strike policy:
- Definition of No-Show: A no-show means accepting a task and subsequently failing to start within the configured grace period of the agreed time, or cancelling immediately prior to the start time, without a valid reason.
- Valid Exemptions: Requester-caused cancellations and valid reasons (such as verifiable emergencies, unreachable requesters, or unilateral task scope changes by the requester) do not count as strikes.
- Strikes & Account Pause: The first no-show results in a warning. Upon accruing two no-shows within a rolling 90-day window, the helper cannot accept new tasks until Karmup conducts an account review. Strikes automatically expire after 90 days.
- Right of Appeal: Helpers retain the right to appeal any strike by providing context, chat evidence, or emergency documentation to platform support.
- Pre-Acceptance Consequence Logging: Prior to accepting any task, a helper must review and acknowledge the consequence notice ("What if I don't do this task after accepting it?"). Karmup securely stores the acknowledgement timestamp and policy version.
8. Multi-Person Tasks Terms (Pending Legal Review)
Where a task requires assistance from multiple individuals:
- Spot Allocation: The requester sets the total headcount needed, and the task display indicates "X of N spots left" as helpers join.
- Per-Person Reward Calculation: Reward is displayed on a per-person basis. If a requester inputs a total budget, the individual reward is calculated as total budget divided by headcount, rounded up to the nearest whole rupee.
- Minimum Headcount & Options: A requester may specify a minimum headcount to start. If fewer helpers accept by the scheduled start time, the requester may proceed with available helpers, reduce the headcount, or cancel without charge or adverse consequence.
- Independent Tracking & Group Chat: Each helper is tracked and evaluated independently. If a helper drops out, their spot reopens without impacting attending helpers. Accepted participants receive access to a dedicated task group chat.
9. Gender Preference Matching Terms (Pending Legal Review)
To facilitate personal comfort and safety preferences for domestic or personal assistance tasks:
- Requester Options: Requesters may select Any, Women, or Men as their preference for an individual task.
- Self-Declared & Private: Helpers self-declare their gender (Woman, Man, Other, Prefer not to say) privately. This declaration is used solely for matching and is never displayed publicly on user profiles.
- Neutral Options: Helpers who choose Other or Prefer not to say do not see gender-filtered tasks.
- Strict Caveat (Not Verified): Karmup does not verify gender. The gender preference is based solely on what users declare and is not a guarantee. Users must always exercise mutual personal caution.
10. Government and Law Enforcement Cooperation
Karmup complies with lawful court orders, government directions, and lawful requests from Indian law enforcement agencies. We preserve platform records and digital evidence, and disclose information where required by applicable law.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of India. Subject to mandatory statutory provisions, any legal proceedings arising hereunder shall be subject to the competent courts having jurisdiction over Abu Road, Sirohi District, Rajasthan, India.
